This Disclaimer explains the role of divefy in connection with scuba diving and related events listed on the platform. By accessing or using divefy, you acknowledge the limitations described below. This document supplements our Terms of Use and Privacy Policy and does not replace them.

Nature of the platform

divefy is a technology platform for discovering, promoting, and managing bookings for scuba diving and related experiences. We provide software, listings, communication tools, and infrastructure so that operators, centers, and dive schools can publicize their events and so that divers can find and request bookings. divefy does not organize, conduct, supervise, or sell dive trips in its own name, except where expressly stated otherwise in writing for a specific offering.

Responsibility of operators and businesses

Each operator, center, school, or business that publishes content or events on divefy is solely responsible for its own operations, listings, staff, equipment, vessels, facilities, and compliance with applicable law. Without limiting the foregoing, each business is exclusively responsible for:

• The accuracy, completeness, and timeliness of event descriptions, prices, schedules, capacity, requirements, and cancellation policies displayed on the platform.
• Obtaining and maintaining all licenses, permits, insurance, certifications, and authorizations required to offer its services.
• Conducting risk assessments, safety briefings, medical screening where appropriate, and supervision of seats during activities.
• Honoring confirmed bookings, waitlist procedures, refunds, and customer communications, according to its own policies and applicable consumer law.
• Any injury, loss, damage, delay, cancellation, or dispute arising from the event or from the relationship between the business and the participant.

Listings and information

Event pages, profiles, photos, reviews, maps, and other materials are supplied by operators or users. divefy does not independently verify every listing and does not guarantee that any event will occur as described, that spots will remain available, or that any particular outcome will be achieved. You should confirm critical details directly with the operator before traveling or making non-refundable arrangements.

Bookings and commercial relationship

When you request or complete a booking through divefy, you enter into a direct commercial and legal relationship with the operator that offers the event, unless we clearly indicate otherwise. divefy is not a party to that contract and is not responsible for the operator’s performance, pricing changes, force majeure, or failure to provide the service. Payment processing, invoicing, chargebacks, and tax obligations may involve third-party providers or the operator’s own systems, as disclosed at checkout or on the operator’s materials.

• Availability, approval, and confirmation of bookings are determined by the operator according to its rules.
• Waitlists, transfers, and cancellations follow the operator’s policies and applicable law.
• Disputes regarding service quality, refunds, or no-shows must be addressed primarily with the operator.
• divefy may provide support tools or messaging features but has no duty to mediate or resolve every dispute.

Your responsibility as a user

• Provide accurate registration and booking information, including certifications and health-related disclosures requested by the operator.
• Assess whether you meet prerequisites for an event (experience level, medical fitness, age, equipment).
• Follow instructions from qualified staff and applicable safety standards during any in-water activity.
• Comply with these Terms, this Disclaimer, and applicable laws when using the platform.

Inherent risks of diving

Scuba diving and related activities involve significant inherent risks, including serious injury or death. Conditions underwater and at sea can change rapidly. By using divefy to find or book experiences, you understand and accept that:

• You participate in activities at your own risk and should obtain appropriate training, insurance, and medical advice.
• divefy does not replace professional judgment by instructors, divemasters, or operators.
• Weather, equipment failure, human error, marine life, and other factors can cause incidents despite reasonable precautions.
• Nothing on the platform constitutes medical, legal, or professional safety advice.

Third-party services and links

The platform may integrate or link to third-party services (such as authentication, maps, analytics, payment processors, or messaging). divefy is not responsible for the availability, security, or practices of those third parties. Your use of external sites or services is subject to their own terms and policies.

Limitation of liability

To the maximum extent permitted by applicable law, divefy and its affiliates, directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business opportunities, arising from or related to:

• Content or conduct of operators, users, or third parties.
• Any event, trip, booking, cancellation, accident, or dispute between seats and operators.
• Unauthorized access, interruption, or errors in the platform, except where liability cannot be excluded by law.

Indemnity

You agree to indemnify and hold harmless divefy from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the platform, your breach of our Terms, your listings or events if you are an operator, or your participation in activities booked through the platform, to the extent permitted by law.

Updates

We may update this Disclaimer from time to time. The “Last updated” date at the top indicates the latest revision. Continued use of divefy after changes constitutes acceptance of the revised Disclaimer, subject to mandatory rights under applicable law.
